PERSONAL INFORMATION GOVERNANCE POLICY OF 9480-6353 Québec Inc. (hereinafter referred to as the «Policy»)

9480-6353 Québec Inc. (hereafter «LeadScout», «we», «our», or «us») collects, uses, retains, and discloses your Personal Information with the aim of providing you with its products or services (including those offered by LeadScout’s third-party partners), or to comply with legal obligations.

The information we collect allows us to identify you, determine your eligibility for requested products and services offered by LeadScout and/or its third-party partners, serve you in a way that meets your expectations, offer you the benefits of being a client and/or user of LeadScout, and effectively manage the risks associated with LeadScout’s activities.

In this Policy, personal information refers to any information about an individual that allows for direct or indirect identification (hereafter «Personal Information»).

This Policy aims to inform you about our practices regarding the collection, use, retention, disclosure, and destruction of your Personal Information. By providing your Personal Information through any means, you consent to LeadScout processing your Personal Information in accordance with the obligations and terms set out in this Policy.

Indeed, by giving your consent, you authorize LeadScout to collect, use, and share the Personal Information about you, so that we can offer you products and/or services provided by LeadScout and/or its third-party partners, including, but not limited to, monetary loans and/or credit facilities.

By giving your consent, you also consent to LeadScout’s third-party partners collecting, using, and sharing the Personal Information about you so that they can offer you their products and/or services. You acknowledge that LeadScout cannot, directly or indirectly, be held responsible under any circumstances, in any manner, for the Personal Information that has been collected by these third parties, which is subject to the privacy policy of those third parties.

LeadScout Solutions will use and share only the necessary Personal Information, unless the law allows otherwise.

This consent to the collection, use, and sharing of your Personal Information is mandatory for doing business with us and takes precedence over any past consent; it remains valid as long as you maintain a business relationship with LeadScout and/or one of its entities.

If you refuse us permission to collect certain personal information, we may be unable to provide you with the requested product or service, and you may be unable to benefit from our products or services.

THE PERSONAL INFORMATION COLLECTED

To provide you with the products or services offered by LeadScout and/or by its third-party partners, LeadScout and its third-party partners may collect the following information from you:

  • Passwords and personal identification numbers (PINs);
  • Answers to security questions;

  • Criminal record;
  • Credit file and score;

Other Information:

  • Social Insurance Number;
  • Proof of citizenship;
  • Proof of residence;
  • Country of birth;
  • Results of checks mainly related to anti-money laundering, cybercrime, and fraud prevention;

HOW YOUR PERSONAL INFORMATION IS COLLECTED

LeadScout and its third-party partners may collect your Personal Information directly from you when you wish to obtain a product or service offered by LeadScout and/or one of its third-party partners, by any means.

LeadScout and its third-party partners may also collect your Personal Information from other people, organizations, or entities, such as:

  • Financial institutions;
  • Service providers;
  • Public bodies;
  • Personal references;
  • Public sources such as registers, official documents, websites, etc.;
  • Other relevant sources for providing you with the requested product or service.

AUTOMATED INFORMATION COLLECTION AND INTEREST-BASED ADVERTISING

LeadScout uses cookies, clear GIFs, third-party analytics, and other tracking mechanisms to track your use of its platforms. When you use a platform, these tracking mechanisms may automatically collect information such as: your IP address, your browser type and operating system; the web pages you view; the links you click on; how you navigate the platform, including the duration of use of the platform or certain features or pages of the platform; and the referral URL, or the web page that led you to the platform. LeadScout may combine this information with other Personal Information collected about you for statistical purposes, to measure the effectiveness of advertising, and for fraud detection.

LeadScout also uses these tools to provide a more personalized user experience, to better understand your needs and preferences, to provide you with content (including advertising) that is most relevant to you, and to monitor trends in the use of its platforms.

LeadScout also uses automated devices and applications, such as Google Analytics (https://support.google.com/analytics/answer/6004245) to evaluate the use of its platforms. LeadScout uses these tools to obtain aggregated statistical information on the use of its platforms to help improve its services, performance, and user experiences. These analytics providers may use cookies and other technologies to perform their services, and may combine the information they collect about you on LeadScout’s platforms with other information they have collected about you from your use of other sites.

USE OF PERSONAL INFORMATION

LeadScout uses your Personal Information to:

  • Identify you, update your Personal Information, and perform any other required internal verification;
  • Open, update, and close your file;
  • Assess your eligibility for requested products and/or services;
  • Ensure proper risk management;
  • Continuously improve our offered products and services;
  • Offer you services or products that meet your expectations;
  • For development purposes to allow us to continually improve our platforms, websites, and offered services;
  • Send you information about our various activities and offers, understanding that you can withdraw your consent at any time;
  • For fraud prevention and detection or for continuous evaluation and improvement of our security measures;
  • Comply with tax requirements;
  • Respond to requests, warrants, and orders from courts and other bodies;
  • To courts, authorities, and other bodies;

LeadScout will not disclose your Personal Information that it collects from you to third parties, except in the normal course of business as follows:

  • To share your Personal Information with courts, law enforcement authorities, and other bodies.
  • To disclose your Personal Information in the event of a business change or dissolution, including, for example, a merger, acquisition, reorganization, consolidation, bankruptcy, liquidation, sale of assets, or winding up of the business.

PROTECTION OF YOUR PERSONAL INFORMATION

The security of your Personal Information is very important to LeadScout. LeadScout makes significant efforts to implement effective security measures to ensure the confidentiality of Personal Information. LeadScout has put in place appropriate and reasonable physical, organizational, contractual, and technological security measures to protect your Personal Information from loss or theft, and from unauthorized access, disclosure, copying, use, or modification by third parties.

TRANSFERS OUTSIDE OF CANADA

Some of LeadScout’s service providers are located outside of Canada. As a result, your Personal Information will be used, stored, and/or accessed in countries other than Canada, including the United States. Please note that when your Personal Information is located outside of Canada, it is subject to the laws of the country where it is located.

DURATION OF CONSERVATION

Your Personal Information is retained as long as necessary for the purposes set out in this Policy and subject to a retention period provided by law.

When the purposes for which your Personal Information was collected are fulfilled and upon the expiration of any retention period provided by law, your Personal Information will be destroyed or anonymized by LeadScout.

LeadScout may retain some of the information for analytical, accounting purposes, as well as for the integrity of account keeping and fraud prevention, collection of required fees, enforcement of terms of use, measures necessary to protect the integrity of the website or its users, or any other measures permitted by law.

LeadScout cannot be held responsible, in any manner, for the Personal Information that has been collected by said third parties, which Personal Information is subject to the privacy policy of those third parties.

RIGHT OF ACCESS AND RECTIFICATION OF YOUR PERSONAL INFORMATION

It is important that the Personal Information we hold about you is accurate and up to date. Please keep us informed if your Personal Information changes.

You have the right to request access to and correction of the Personal Information we hold about you.

LeadScout commits, at your request, to confirm the existence of your Personal Information, provide you with access to it, and allow you to obtain a copy in a commonly used and machine-readable technological format.

You have the right to require the rectification of Personal Information that is inaccurate, incomplete, or ambiguous, or the deletion of Personal Information if its collection, use, disclosure, or retention is not authorized by law.

You also have the right to require LeadScout to stop the dissemination of your Personal Information when such dissemination violates the law, a judicial order, or when the following conditions are met: i) it causes you serious harm related to the respect of your reputation or your privacy, ii) this harm is clearly greater than the public interest in knowing this information or the interest of any person to express themselves freely, and iii) the cessation of dissemination requested does not exceed what is necessary to prevent the perpetuation of harm. In all cases, your request for access or rectification must be made in writing by justifying your identity as the person concerned by the Personal Information.

WITHDRAWAL OF YOUR CONSENT

You have the right, at any time, to withdraw your consent to the communication, retention, or use by LeadScout of your Personal Information.

However, when the Personal Information is necessary to offer you our products and/or services (including those of third-party partners), the withdrawal of your consent may result in the refusal or impossibility for LeadScout to provide you with its products and/or services (including those of third-party partners), as applicable.

MODIFICATION OF OUR POLICY

LeadScout commits to publishing all amendments made to the Policy. If we make significant changes to how we process Personal Information, you will be informed.
